5.3 Global Privacy Control

We honor Global Privacy Control (GPC) signals where required by applicable law. If your browser sends a GPC signal, we will treat that signal as a request to opt out of the sale or sharing of personal information for cross-context behavioral advertising purposes.

6. Advertising and Analytics

We use Meta Pixel and Google Ads to measure the effectiveness of our marketing and to deliver relevant advertising to people who have visited our site. These tools may collect information about your interactions with our site and use that information, in combination with information from your interactions with other websites, to show you ads on Facebook, Instagram, the Google Display Network, YouTube, and other platforms.

Under certain U.S. state privacy laws, the use of these advertising tools may be classified as "sharing" or "sale" of personal information for purposes of cross-context behavioral advertising. You can opt out as follows:

For California residents, see Section 9 for additional rights to opt out of sharing under the CCPA/CPRA.

  • Legal requirements: when required by law, court order, or government request, or to protect our rights, safety, or property.
  • Business transfers: in connection with a merger, acquisition, financing, or sale of assets.
  • With your consent: for any other purpose for which you give us explicit permission.

  • Access, correction, deletion, restriction, and portability of your personal information
  • Objection to processing based on legitimate interests
  • Withdrawal of consent at any time, where processing is based on consent
  • The right to lodge a complaint with your local data protection authority

  • Legal obligation (tax records, regulatory compliance)

To exercise GDPR rights, email mazzy@thefitcollective.com.

12. Data Retention

We retain personal information only as long as needed for the purposes described in this Policy or as required by law:

  • Email subscribers: until you unsubscribe, plus a short retention period for anti-spam compliance
  • Program participants: for the duration of your access plus a reasonable post-access period for support, refund eligibility, and tax records
  • Quiz responses: for the duration of your engagement with us, plus aggregate/de-identified analytics retained indefinitely
  • Transaction records: typically seven years, to comply with tax and accounting requirements
  • Site analytics: Google Analytics is configured for a 14-month retention period where configurable

You can request deletion of your data at any time by emailing us, subject to the legal retention requirements noted above.

13. Data Security

We rely on the security practices of our third-party platforms (Kajabi, Stripe, Squarespace, Typeform, Acuity, Trainerize) to protect your information. These providers maintain industry-standard security measures including encryption in transit and at rest, access controls, and security auditing.

No system is perfectly secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security. If you believe your information has been compromised through our site, please contact us immediately.

Please do not send us sensitive health information, medical records, or detailed clinical details via email, contact forms, or our platforms. We are not a healthcare provider and are not equipped to receive or store protected health information.

14. Children's Privacy

Our website and programs are designed for adults. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).

The Fit Kid Program™ is a product for children, but all enrollment, account management, payment, and platform interaction is conducted by a parent or legal guardian. Children themselves do not create accounts, submit quizzes, or otherwise interact with our website. Children participate in the program offline, with parent supervision, using content their parents access through our adult-facing platform.

If we learn that we have inadvertently collected personal information from a child under 13 without verifiable parental consent, we will delete that information promptly. If you believe we may have collected information from a child, please email mazzy@thefitcollective.com.

15. Sensitive Health Information

Our DistressRx™ Assessment and Family Stress Type Quiz ask questions about stress patterns, family dynamics, and emotional responses. These responses are not clinical assessments and are not used to diagnose, treat, or provide healthcare services.

Quiz responses are collected through Typeform and stored within our Typeform and Kajabi accounts. We use aggregate, de-identified response data to refine our methodology and content. We do not share individual quiz responses with third parties for marketing purposes.

We are not a HIPAA-covered entity. Information you provide through our website is not protected health information (PHI) under HIPAA. Do not provide medical records, clinical notes, lab results, or other detailed health information through our forms, email, or platforms.

16. International Visitors

Our website is operated from the United States. If you visit our site from outside the U.S., your information will be transferred to, stored, and processed in the United States. By using our site, you consent to this transfer.

For visitors in the European Economic Area, United Kingdom, and Switzerland: where required, we rely on Standard Contractual Clauses or other approved transfer mechanisms to safeguard cross-border data transfers.

17. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through reasonable means, such as a notice on our website or by email to subscribers. The "Last Updated" date at the top of this Policy indicates when it was last revised. Your continued use of our site after such updates constitutes acceptance of the revised Policy.
